Descripción del trabajo
Our company was established in 1997 and incorporated on January 8, 2007, in Carnelian Bay, California. Our business model consists of selling Belgian waffles, French hot dogs (hot dogs in a baguette), French crepes, and other snacks, along with non-alcoholic beverages, at multiple food concession kiosks located at ski resorts. The company also operates ice cream, frozen yogurt, and candy stores, as opposed to kiosks, at the ski resorts. The need for H-2B workers is for our operations at the Northstar, Palisades Tahoe, and Homewood ski resorts. We have food concession kiosks and stores at three renowned ski resorts in the Lake Tahoe area: Northstar, Palisades Tahoe, and Homewood. Our sales locations are as follows: one store at Northstar; two kiosks and one store at Palisades Tahoe; and one kiosk at Homewood. Each kiosk and store is open 10 hours per day, 7 days per week during the ski season pursuant to our licensing agreements with the ski resorts. These are therefore multi-shift locations, with approximately 3 full-time employees per kiosk and between 3 and 8 full-time employees per store. The ski resorts are seasonal markets and, consequently, our operations are seasonal as well. The candy, ice cream, and frozen yogurt stores are open year-round, but their hours and days of operation are limited during the spring, fall, and summer. All kiosks are open during the winter season and closed during the fall and spring seasons. During the summer season, only two stores are open: one at Northstar and one at Palisades Tahoe. The seasons are defined as follows, although start-up and end dates may vary based on snowfall: Spring : May and June - Very little activity. Our sales from the stores were $13,642 in May 2026 and $37,543 in June 2026. Only stores were open, and all kiosks were closed. Summer: July and August - medium activity. Our sales were $136,259 in July 2026 and $76,281 in August 2026. All kiosks were closed. Winter: December through the end of April - High season. Our sales were $209,808 in December 2025, $317,625 in January 2026, $274,635 in February 2026, $209,118 in March 2026, and $46,476 in April 2026. All kiosks and stores were open. Autumn: September, October, and November - Minimal activity. Our sales from the stores were $25,183 in September 2025, $4,201 in October 2025, and $34,312 in November 2025. All kiosks were closed, and only the stores were open. For many years, we relied 100% on J-1 agencies, such as Risk and Rewards Management, CCI Greenheart and CCUSA, to provide our seasonal workers because we cannot find a sufficient number of workers in the Lake Tahoe area. However, it became increasingly difficult to obtain the number of J-1 workers needed through these agencies because the pool of available J-1 workers became more limited. In previous years, many ski resorts were required to close earlier than anticipated due to insufficient snowfall, resulting in J-1 workers being sent home earlier than expected. This negatively affected interest in the J-1 program for this type of seasonal employment. As a result, we have successfully relied on the H-2B program to obtain the seasonal workers needed for our operations during the last several years. We continue to face a critical labor shortage because other businesses operating at the Northstar, Palisades Tahoe, and Homewood ski resorts in the Lake Tahoe area are also competing for seasonal workers. Please see the letters from Northstar, Palisades Tahoe, and Homewood ski resorts enclosed with the supporting documentation. If we are unable to obtain sufficient seasonal workers, we will not be able to open and operate our kiosks and stores for the hours required under our licensing agreements with the ski resorts. Failure to meet these contractual operating requirements could place us in breach of our licensing agreements and jeopardize our continued operations at these locations and, ultimately, the viability of our business.
