Summary of the Employer and the Need C R Unlimited Services LLC (CRU) is a Florida limited liability company with its place of business at 8115 Annabellas Ct, Panama City Beach, Florida 32407. CRU provides contracted operational support to resort and resort-condominium properties on the Florida Gulf Coast. It seeks certification for five (5) temporary, full-time Winter Season Maintenance and Repair Workers for the period November 15, 2026 through March 15, 2027. CRUs need arises from winter refurbishment and project-maintenance programs at three managed resort-condominium properties in Bay County, Florida: Laketown Wharf, Shores of Panama, and Tropic Winds. Each has executed a signed Letter of Intent identifying the number of Maintenance and Repair Workers it will contract from CRU for the winter off-season and the fixed monthly package of project work each of those workers will perform. Those Letters of Intent are Exhibits A through C. The five workers requested are not an estimate; they are derived arithmetically from the contracted work packages, as shown in Part V. The work at issue is not guest-driven daily service. It is project-based work performed in vacant guest rooms, closed sections, and low-traffic public areas: room-by-room refurbishment punch lists that require a room to be held out of order for several consecutive days; scheduled preventive maintenance and life-safety inspection routes that require access to every room on a floor; and planned projects in lobbies, corridors, stairwells, fitness rooms, laundry, and storage areas that require those spaces to be closed or lightly trafficked. That is why the work can only be performed when occupancy is at its annual low, and why it ends when occupancy recovers. Companion application. CRU has separately applied for certification of twenty (20) Winter Season Housekeeper positions (SOC 37-2011; prevailing wage determination P-400-26127-882713; SWA Job Order No. 12548803) at the same three properties for the same period. The two engagements are distinct. The housekeeping engagement is the deep cleaning of units released from rental inventory; this engagement is the mechanical and cosmetic refurbishment of rooms held out of order, together with scheduled preventive maintenance, life-safety inspection, and public-area and back-of-house projects. No worker performs both. CRU discloses the companion application so that the record is complete, and Part V.B uses the released-unit figures from that application as an independent cross-check on the volume of work contracted here. II. CRU Is the Sole Employer of the Requested Workers Because CRU performs services at properties it does not own, the threshold question is whether CRU is the employer of the requested workers or a job contractor within the meaning of 20 C.F.R. 655.5. CRU is the employer. It exercises substantial, direct, day-to-day supervision and control over the performance of the work, and not merely the authority to hire, pay, and fire. The following facts, each confirmed in Sections 6 and 7 of every Letter of Intent at Exhibits A through C, establish that relationship: CRU recruits, hires, and employs the workers directly. No employment relationship, joint or otherwise, is created between any client property and any worker furnished. CRU alone sets and pays wages, withholds and remits taxes, carries workers compensation coverage, and administers all payroll and personnel functions. Day-to-day supervision, scheduling, work assignment, and quality control are provided by CRU through its own on-site supervisor, who is an employee of CRU and is not an H-2B worker. A client property may identify the out-of-order rooms and closed areas it releases for work and may inspect completed work for acceptance, but does not direct the manner or means by which the work is performed.
