Our family has been in the Carnival Business all our lives, providing entertainment and concessions on a seasonal basis. This company was established in 2025. Congress has recognized the inherent seasonality of the mobile entertainment business as detailed in the Fair Labor Standards Act section 13(a)(3). The U.S. DOL has also noted the unique nature of the mobile entertainment business, and this application is being filed under the long-standing special procedures that the Department established and incorporated into the current regulatory framework for these mobile, multi-generational, seasonal, small family businesses. We have a seasonal need for these workers, recurring on a predictable annual basis. We are open for a specific season each year, a traveling business, the work is evenings and weekends, and therefore it is very difficult to find workers willing We need temporary seasonal workers to augment our U.S. Workforce and to sustain our business. For the past several seasons, this need has been recurrent annually from November through September. We completely cease our mobile operations from September through November and do not have any permanent workers in this job category. The number of workers required to operate our show is obviously dictated by the equipment (food concessions) that we operate at our various locations, the hours of operation, and the number of workers that are required to safely (for the workers themselves, their fellow workers, and for the public) maintain and operate those concessions. These are the factors that I take into consideration as I calculate my need for workers so that I can accurately complete this application process, remain compliant with and strive to protect the integrity of this vital H-2B non-immigrant foreign worker program. We have reviewed the staffing levels on our food concessions, our hours of operation at the various fairs, festivals and events in which we service, and to ensure that our employees have proper breaks and there is sufficient staffing to meet insurance company and concessions manufacturers standards for operation, and this is how we calculated the number of workers needed. To further document our need for Amusement and Recreation Attendants Carnival, the listing of food concessions and the number of workers required to safely operate these food concessions for the 2027 season is as follows: Food Concession 6 Amusement and Recreation Attendants / Operators Break Workers 6 Amusement and Recreation Attendants / Operators This is a total of 12 workers. We historically have been able to hire 2 U.S. workers to fill these slots (and other slots such as management, supervisor, office staffing) so we are only requesting 10 workers for our seasonal need. The temporary need is seasonal, predictable and recurrent annually. For the current fiscal year, we calculated and filed for 10 Amusement and Recreation Attendants Carnival, for the period of December 5, 2026, through September 4, 2027. The reason we are filing for a short period of time this season is due to our prevailing wage being determined late by the NPWC and in order to meet the filing requirements our start date needs to be adjusted to December 5th, our true filing date is for November 4th. We have not applied for H-2B Certification in the past and have had an incredibly difficult time being able to staff our business. Due to inadequate staffing, the workers that we have been able to hire have had to endure the stress of working without adequate assistance and by hiring Temporary, Seasonal Foreign Workers to augment our U.S. staff we hope to be able to provide better working conditions for all by being fully staffed. We engage in extensive recruiting in hopes of fulfilling our seasonal need. CONTINUED ON ATTACHMENT
