Employer makes all payroll deductions required by law. Employer does not envision other workforce-wide payroll deductions. Voluntary deductions must be pre-authorized in writing and may include the following: If requested, employer helps non-local workers secure optional worker-paid lodging. Employer deducts reasonable fair market value cost of rent/utilities based on number of occupants for workers electing to reside in employer-provided housing (cost TBD). Employer offers free daily transportation to/from worksite from designated pick-up location. Use of transportation is voluntary. Employer provides incidental transportation between worksites as necessary. Such transportation complies with all applicable Federal, State, and local laws/regulations. Sick time provided in accordance with Michigan state law.

(Continued with evidence on attachment) Exterior Concepts Inc is a Snow Removal and Winter Maintenance company primarily engaged in commercial and residential snow removal services. We have a temporary, seasonal need for 6 workers to be employed as Crew Members (SOC 37-2011: Janitors and Cleaners, Except Maids and Housekeeping Cleaners) at our location in Shelby Twp, Michigan. We are a new H-2B program user. In the past seasons we have attempted to recruit local U.S. workers to meet our seasonal labor needs. However, it has become difficult in recent years to locate a sufficient number of domestic workers to fill these temporary positions. Due to this, we have turned to the H-2B program to secure a reliable temporary workforce for our period of need. Our requested period of need is consistent with historical norms for the occupation in our area of employment. As proof of our business existence, the Michigan Secretary of State recognizes our business as an active Domestic Profit Corporation in Good Standing . Regulatory Standards Per the regulations, a seasonal labor need is one in which the employers need for services or labor is traditionally tied to a season of the year by an event or pattern and is of a recurring nature. Employment is not considered seasonal if the period during which the services or labor is not needed is unpredictable or subject to change or is considered a vacation period for the employers permanent employees. The request for seasonal workers must also represent bona fide job opportunities for the number of workers requested. Period of Need Our labor need is tied to the requested period of need by both natural factors such as sunlight, weather, and temperature, as well as fluctuations in consumer demand and other market conditions throughout the year. This pattern is both predictable and recurring, and it is not a vacation period for our permanent employees. Our labor need begins at the end of November, at the onset of the winter storm season. We perform the same duties throughout the winter season. During and after winter storms workers deal with winter storm cleanup and snow/ice removal. When not dealing with winter storms workers will perform dormant tree, shrub pruning and clean up beds. This need for seasonal workers ends in April when business activities diminish due to the onset of warm weather and the corresponding decline in customer demand.
