Employer makes all payroll deductions required by law. Employer does not envision other workforce-wide payroll deductions. If requested, employer helps non-local workers secure optional worker-paid lodging (not to exceed fair market value, based on number of occupants; cost TBD). Housing costs paid directly to landlord and are not payroll deducted. Voluntary advances and/or loans made to workers, if any, may be repaid by pre-authorized payroll deductions. Employer provides incidental transportation between worksites as necessary. Employer may deduct reasonable costs for daily transportation to/from worksite from designated pick-up location. Use of employer-provided transportation is voluntary.

Descripción del trabajo

I. Background C.P.'s Lawncare LLC (established in 2000) is a Zanesville, OH-based employer engaged primarily in landscaping and snow removal. We have a temporary, seasonal need for 10 workers to be employed as Winter Technicians (SOC 37-2011.00 Janitors and Cleaners, Except Maids and Housekeeping Cleaners). We are a returning H-2B program user, having previously used the program to meet our temporary need for Landscape Laborers during the fair-weather months of the year. The instant application requests Winter Techniciansa seasonal position that we were previously able to staff with domestic workers. Winter Technicians perform snow/ice removal as well property winterization tasks (e.g., debris cleanup, dormant pruning) and equipment maintenance incidental to snow/ice removal. Accordingly, this position is necessary during the late fall, winter, and early spring months only. In recent years, we have found it difficult to locate a sufficient number of qualified and available U.S. workers and have thus turned to the H-2B program once again. II. Regulatory Standards Per the regulations, a seasonal labor need is one in which the employers need for services or labor is traditionally tied to a season of the year by an event or pattern and is of a recurring nature. Employment is not considered seasonal if the period during which the services or labor is not needed is unpredictable or subject to change, or is considered a vacation period for the employers permanent employees. The request for seasonal workers must also represent bona fide job opportunities for the number of workers requested. III. Temporary Need A. Period of Need Our labor need is tied to the requested period of need by both natural factors such as sunlight, weather, and temperature, as well as fluctuations in consumer demand and other market conditions throughout the year. This pattern is both predictable and recurring, and is not a vacation period for our permanent employees. Our labor need begins in December. At this time, the growing season wanes, and cold, inclement weather begins to set in. This prompts homeowners and businesses to begin preparing their properties for winter. This drives consumer demand for our services, thus necessitating a seasonal Winter Technician workforce. Due to the nature of the work performed, the Winter Technician position is strictly seasonal. There is no need for snow/ice removal or winterization during the non-winter months of the year because temperatures are above freezing, and snowfall does not occur (see Figures 1 and 2). Accordingly, we have no need to retain any Winter Technicians beyond the requested period of need, satisfying the regulatory requirements for a seasonal standard of need. Seasonal operations typically begin with debris removal and dormant pruning of plants and shrubs, which must take place in advance of the first snowfall, thus informing the requested start date of the instant application. Routine maintenance is also performed on all snow equipment to ensure it is in optimal working condition before the winter season begins. This involves routine tasks such as inspecting and servicing components including plow blades, hydraulic systems, electrical connections, and lighting. Engines and fuel systems are checked for performance, and fluids like oil and coolant are changed as needed. Tires or tracks are examined for wear, and all moving parts are lubricated to prevent freezing or malfunction. This preventative maintenance helps reduce downtime during snow events and ensures that equipment is reliable and ready to operate efficiently when winter weather arrives. As the season progresses, snowfall and ice buildup become prevalent, requiring prompt removal services to maintain the safety and accessibility of clients properties and meet our contractual obligations.
