Pay deductions:
Employer makes all payroll deductions required by law. Employer does not envision other workforce wide payroll deductions. If requested, employer helps non-local workers secure optional worker paid lodging. Employer deducts reasonable fair market value cost of rent/utilities based on number of occupants for workers electing to reside in employer based housing (cost tbd). Employer provides incidental transportation between worksites s necessary. Employer offers free daily transportation to/from worksite from designated pick-up location. use of transportation is voluntary.

Work description

Nature of Business A & N Lawn Service, Inc., established in 1996, is a family-run business that offers a variety of outdoor solutions for homes and businesses, including exceptional snow removal for our commercial customers. We offer 24-hour emergency snow removal service, including: snow plowing, shoveling, salting, de-icing, hauling, and stacking. We generally perform this non-agricultural seasonal work from winter through spring. Our H-2B dates of need are consistent with the regularly recurring annual business cycle customary to our industry and location. Temporary Need Our labor need does not exceed ten months, which is consistent with USCISs definition of temporary need. This position is temporary in nature and is based on the seasonality of snow removal in our area of intended employment. Our business is dependent on annually recurring natural conditions, including weather, sunlight, and temperature. We require workers seasonally in the months when we reliably perform the bulk of our full-time work activities; our workload increases dramatically with the onset of warm weather. Operations typically begin with: winter clean-up, planting preparation, and equipment maintenance; perform winter pruning, tree wrapping, and other seasonal plant protection tasks; assist with projects such as hardscape repairs, holiday tree set up and clean up, equipment maintenance and site clean-up. Duties such as snow removal, applying calcium or other ice melt products, sand to prevent slippery conditions; and maintain safe and efficient work practices during winter weather conditions are ongoing throughout the winter weather months. Our temporary need for H-2B workers ceases with the onset of fair-weather months, when it becomes warm enough that the prospect of snow and bad weather has ended. The seasonal pattern is both predictable and recurring in nature. Standard of Seasonal Need Our temporary need is tied to the recurring winter seasons of the year as described in the preceding section. We do not require Winter Sidewalk Crew Members during the off months due to the lack of consistent work during that period. The off months are predictable and not subject to change, barring minor adjustments due to external factors. The requested H-2B workers are not covering for vacationing permanent employees. Justification for Period of Need and Number of Workers Based upon past, current, and projected business volume, as well as local economic conditions, we anticipate needing five (5) full time temporary H-2B workers between December and March.
