Work description

Southeast Thoroughbred Racing, LLC (established in 2012) is an employer engaged primarily in training thoroughbred race horses. We have a temporary, seasonal need for 12 workers to be employed as Stable Attendants (SOC 39-2021 Animal Caretakers) at our stable location at Belmont Park in Elmont, New York. We are a returning H-2B program user, but this is our first winter operation at Belmont Park. Unlike our established Florida operations at Payson Park and Gulfstream Park, the Belmont winter operation could not have produced prior-year Belmont payroll, revenue, contract, or H-2B staffing records because the newly rebuilt track has not previously offered the winter racing program on which this request is based. The absence of historical Belmont records reflects a genuinely new operation, not a permanent or year-round need that has been artificially limited to several months. I. Regulatory Standards Per the regulations, a seasonal labor need is one in which the employer's need for services or labor is "traditionally tied to a season of the year by an event or pattern and is of a recurring nature." Employment is not considered seasonal if the period during which the services or labor is not needed is unpredictable or subject to change, or is considered a vacation period for the employer's permanent employees. The request for seasonal workers must also represent bona fide job opportunities for the number of workers requested. II. Temporary Need A. Period of Need The event that creates our need is Belmont Park's newly established winter racing program. The New York Racing Association (NYRA) announced that the rebuilt Belmont Park will reopen in September 2026 with a new one-mile Tapeta track designed for winter racing. NYRA's published calendar distinguishes the regular fall meet, which ends December 6, from the inaugural 2026-2027 Belmont Park winter meet, which begins December 10 and continues into 2027. NYRA also announced 11 live racing days during December. This is an objective, scheduled winter event that did not exist at Belmont in prior seasons and directly creates the opportunity for us to send a separate string of horses to Belmont for the winter. NYRA explains that the Tapeta surface is intended to serve as the exclusive winter racing surface and remains highly consistent in cold conditions and heavy rain. NYRA and Woodbine have also announced the Empire Trillium Series, with eight stakes races scheduled at Belmont between December 2026 and February 2027. This date is ten days before the first scheduled winter-meet race day. During this necessary preparation period, our Belmont winter horses and equipment must arrive, stalls must be assigned and prepared, feed and bedding must be organized, and the horses must be acclimated and placed into their winter training routines. Stable Attendants are required from the horses' arrival because feeding, watering, stall cleaning, grooming, walking, blanketing, and health monitoring begin immediately and must be performed every day, including non-race days. The need continues through the winter racing and training program while our designated Belmont winter string remains physically stabled at this worksite. The live racing calendar drives the operation, but the care work is continuous: horses require daily care before, between, and after their individual race dates. (Continued on attachments).
