Background Paradise Garden Center, LLC is a nursery and garden center that primarily operates as a seasonal garden center. As our business has evolved, we now offer landscaping services to our clients during the winter months when the nursery is closed and in the early spring we plant the products we sell at the nursery. We have a temporary, seasonal need for 6 workers to be employed as Winter Laborers (SOC 37-3011 Landscaping and Groundskeeping Workers) at our location in Shelby, NC. We are a new H-2B program user. We have not historically offered these services, so this will be our first year in the landscape winter maintenance and spring planting services. As proof of our business existence and authorization to operate, the North Carolina Secretary of State recognizes Paradise Garden Center, LLC as an active Domestic Profit LLC in good standing, and the North Carolina Department of Revenue confirms the companys registration under Federal Employer Identification Number (FEIN) 46-5205752. Regulatory Standards Per the regulations, a seasonal labor need is one in which the employers need for services or labor is traditionally tied to a season of the year by an event or pattern and is of a recurring nature. Employment is not considered seasonal if the period during which the services or labor is not needed is unpredictable or subject to change or is considered a vacation period for the employers permanent employees. The request for seasonal workers must also represent bona fide job opportunities for the number of workers requested. Period of Need Our labor need is tied to the requested period of need by both natural factors such as sunlight, weather, and temperature. This pattern is both predictable and recurring, and it is not a vacation period for our permanent employees. Our labor need begins in December at the start of the snow season in our area. Shelby, NC sits at the foothills of the Blue Ridge Mountains, and despite the southern location averages 4 inches snow every year. The snow season is December through March, with the peak being January and February. The need for available winter laborers to remove snow from our clients properties is the basis for our seasonal need. When not performing snow removal activities, the workers will be performing tree trimming and pruning on dormant trees. In the spring, we will provide flowers and mulch from our garden center to these clients. At the conclusion of the spring planting time, our need for seasonal winter laborers concludes and our focus is back on our nursery and garden center operations. Number of workers Based on our analysis of current business projections, Paradise Garden Center, LLC has determined that a bona fide need exists for 6 seasonal Winter Laborers during the requested period of need. We currently have 36 commercial and industrial client properties to provide planting and winter maintenance services. The value of this work is approximately $400,000 for the season.
