Work description
Our need for temporary workers is seasonal in nature, as defined by 20 CFR 655.6 and 8 CFR 214.2(h)(6)(ii)(B)(2). Our demand for temporary labor is directly tied to a recurring increase in workload and labor requirements caused by winter weather conditions and the corresponding increase in snow and ice management, winter storm response, and winter property cleanup services. These conditions occur during a recurring period of the year and generate service requirements that exceed the productive labor capacity of our permanent workforce. Our company operates year-round and provides a variety of grounds maintenance and landscape restoration services. However, the temporary positions requested in this application are not based upon our general year-round workload. Rather, the requested workers are needed specifically to supplement our permanent workforce during the recurring winter season when snowfall, freezing temperatures, ice accumulation, and winter storms create a substantial increase in snow and ice mitigation and storm-cleanup requirements. Our Grounds Maintenance Workers, All Other, perform winter-specific duties including commercial and residential snow removal, recovery and rehabilitation of degraded topography, plowing, shoveling, ice removal, deicing, snow hauling, winter storm cleanup, removal of storm-generated debris, and related winter property maintenance. These services are inherently seasonal because the demand for this work is directly associated with recurring winter weather conditions. The same level of snow and ice mitigation labor is not required during the warmer months when conditions requiring these services are generally absent. Large-Scale Commercial Snow and Ice Mitigation A significant component of our seasonal workload involves large-scale snow and ice mitigation for commercial properties and other multi-site customers. Commercial snow and ice operations frequently involve parking lots, access roads, loading areas, sidewalks, pedestrian routes, entrances, driveways, fire lanes, and other areas that must remain accessible during and following winter storms. Unlike routine grounds-maintenance work, commercial snow and ice mitigation often requires a coordinated response involving multiple employees, equipment operators, laborers, and service crews working simultaneously at different locations. A single significant winter storm can create a substantial and immediate increase in labor requirements because numerous contracted properties may require service within the same limited response period. Our commercial customers may require snow plowing, snow relocation or hauling, sidewalk clearing, ice removal, pretreatment, deicing, post-storm cleanup, and repeated applications of deicing materials. These services may need to be performed more than once during a single storm or across consecutive weather events. The labor requirement therefore increases not only because of the amount of snow or ice present, but also because multiple properties must be serviced within contractual response times. The size and geographic distribution of our commercial service areas further increase the labor requirement. Employees cannot perform simultaneous snow and ice mitigation operations at multiple properties at the same time. When several contracted properties require service concurrently, separate crews must be deployed to meet customer requirements. Accordingly, the seasonal labor shortage represents a need for additional personnel and productive labor capacity, rather than simply additional hours from the same employees.
