Work description

Our need for temporary workers is seasonal in nature, as defined by 20 CFR 655.6 and 8 CFR 214.2(h)(6)(ii)(B)(2). Our demand for temporary labor is tied to an increase in actual workload and labor requirements that exceed our permanent staff abilities. This increase of workload is caused by recurring winter weather conditions and the seasonal increase in snow and ice management services as well as traditionally scheduled holiday decoration services that our team will complete such as decorations and lights that are performed during the requested period of employment. This increase in workload occurs at the same time each year and requires a temporary increase in staffing levels as it exceeds the capacity of our permanent workforce. Snow and ice management and winter storm response are services generated by recurring winter conditions and therefore are not required at the same level during the warmer months. The temporary positions are needed specifically to perform this recurring seasonal workload. Our Grounds Maintenance Workers, All other teams only perform seasonal job duties that include snow and ice removal, winter storm cleanup, and seasonal decorating services that are tied to a specific season of the year and recur annually. Our winter operations include snow and ice removal, winter storm clean-up, and the seasonal holiday decoration services, including garland, lighting, and other holiday-specific displays. These services are inherently seasonal because demand is directly associated with recurring winter weather conditions, including snowfall, ice accumulation, freezing temperatures, and winter storms, as well as holidays occurring during a limited portion of the year. Although our company operates year-round and performs a variety of grounds-maintenance and landscaping services, the temporary positions requested in this application are not based on the company's general year-round landscaping workload. Rather, the requested positions are specifically associated with the recurring seasonal increase in snow and ice management, winter storm response and cleanup, seasonal holiday decoration installation and removal, and other winter-related services that occur during the identified seasonal period. These activities create an additional labor requirement that does not exist at the same level during the remainder of the year. During the winter season, our workload increases significantly and exceeds our permanent workforce labor hours capacity. The timely performance of snow and ice mitigation services is essential to protecting people and property during winter weather events. Snow removal, ice removal, and application of deicing materials reduce hazardous conditions on parking lots, driveways, sidewalks, walkways, entrances, and access routes, thereby helping prevent slips, falls, vehicle-related incidents, and property damage. Because these conditions can develop rapidly following snowfall or freezing precipitation, the services must often be performed promptly and repeatedly throughout a winter weather event. Our snow and ice management operations follow established industry standards and best practices, including the proper use of snow-removal equipment, deicing materials, storm clean-up procedures, and safety practices. Industry organizations such as the Snow & Ice Management Association (SIMA) provide recognized guidance for performing these services effectively under varying winter conditions. The need for additional workers is temporary and limited to the winter operating season, when labor requirements exceed our permanent workforce capacity caused by snow, ice, winter storms, and seasonal holidays. Once winter weather conditions subside and holiday-related demand returns to normal levels, the additional seasonal workload ends, and our permanent workforce has the capacity to meet its operational needs.
