If requested, employer helps non-local workers secure optional worker-paid lodging. Employer deducts reasonable fair market value cost of rent/utilities based on number of occupants for workers electing to reside in employer-arranged housing (cost TBD). Employer provides incidental transportation between worksites as necessary. Employer offers free daily transportation to/from worksite from designated pick-up location. Use of transportation is voluntary.

Work description

Kesten Poured Wall, Inc. (established in 2007) is a Pittsburgh, Pennsylvania-area poured-concrete contractor. We request 12 Concrete Finishers (SOC 47-2051.00, Cement Masons and Concrete Finishers) from December 13, 2026 through February 28, 2027 for a narrow, recurring winter flatwork and horizontal-surface finishing season. This request is separate from our February 12 through December 12 Construction Laborer order (SOC 47-2061.00), which supports our primary vertical poured-wall operation. Our two orders do not divide one year-round position into artificial segments. They cover different occupations, work products, tools, and phases of concrete construction. Our Construction Laborers erect, position, strip, clean, and move wall-form systems and assist with vertical wall pours. Our Concrete Finishers perform the skilled surface work that begins after concrete is placed on horizontal applications: screeding and leveling; floating and troweling; edging and jointing; applying curing compounds, sealants, hardeners, and protective finishes; monitoring curing; grinding, polishing, patching, and correcting defects; and meeting specified tolerances, textures, and architectural finishes. The distinction is confirmed by federal occupational sources. O*NET and the Bureau of Labor Statistics define Concrete Finishers by smoothing and finishing poured surfaces such as floors, walks, roads, and curbs with specialized hand and power tools. By contrast, Construction Laborers perform broad supporting work that includes positioning or dismantling concrete forms and placing or protecting cast-in-place structures. The fact that both occupations work with concrete does not make their actual duties interchangeable. See Tab A. I. Regulatory Standards Per the regulations, a seasonal labor need is one in which the employers need for services or labor is traditionally tied to a season of the year by an event or pattern and is of a recurring nature. Employment is not considered seasonal if the period during which the services or labor is not needed is unpredictable or subject to change, or is considered a vacation period for the employers permanent employees. The request for seasonal workers must also represent bona fide job opportunities for the number of workers requested. II. Temporary Need A. Period of Need, Seasonal Trigger, and Definable End Our need is seasonal because the concrete-finishing services themselves (not merely our overall business) are tied to a fixed and recurring winter pattern. The trigger is the annual transition on December 13 from our principal vertical poured-wall cycle to a short flatwork and horizontal-finishing cycle. Three customers (H & K Concrete, BMH Homes, and Kesten General Contracting) have accepted letters of intent for flatwork and finishing services for the same December 13, 2026 through February 28, 2027 window. Each letter identifies the same specialized finishing sequence, from screeding through curing control and final correction of surface defects. See Tab D. This is not a new or unpredictable arrangement. Our payroll shows Concrete Finishers only in December, January, and February. In 2024, we employed 9 finishers in January, 9 in February, and 10 in December, but zero in every month from March through November. In 2025, we employed 9 finishers in January, February, and December, but zero from March through November. In 2026, we employed 9 in January and 11 in February, followed again by zero from March through August, the completed months reflected in the record. The same pattern appears in the hours and earnings: the designated occupation generated no reported hours or earnings from March through November in 2024 or 2025 and none from March through August 2026.
